Overview
This submission provides AIFS’ evidence-informed feedback to the NSW Department of Communities and Justice on the statutory review of the Crimes Legislation Amendment (Sexual Consent Reforms) Act 2021. It examines whether the reforms deliver clarity, strengthen consent law, and address common misconceptions about sexual assault.
Drawing on AIFS research, national data and other material, this evidence-based submission identifies the introduction of affirmative consent as a positive step towards safeguarding people against, and responding to, sexual violence in NSW. It also identifies options for improved jury directions and for the protection of people at high risk of sexual assault, such as sex workers. It also highlights the need for law reform to be supported by broader prevention and education initiatives to improve understanding of affirmative consent and support safe sexual relationships across the community.
